Collections attorneys cannot sue a debtor for their fees because they have no contract with the debtor nor have they performed any service for the debtor. Furthermore they have no need to sue the debtor for their fees since that is already covered in the original contract with the debtor upon which the creditor sues.
So what happens is that the creditor hires the attorney, usually paying the attorney a flat fee for each suit that he files. When the judgment is granted by the court it then becomes the attorney's job to actually accomplish the collection of the judgment by means of garnishment if the debtor does not pay voluntarily. As money is collected the attorney forwards the collected funds to the client minus any additional attorney fees that might have accrued since the judgment was granted. Those fees are also added into the amount the debtor owes and may eventually have to pay.
Most attorneys will demand an upfront fee from the client because he would probably just about starve to death if all he got out of his efforts was the collected amount. Only about 20% of all judgments are ever collected nationwide so if the attorney did not get paid by his clients
but rather waited to get paid from the approximetly 20% of his work that actually resulted in successful collection then obviously 80% of his work would be wasted effort.
